Terms and Conditions

1. Scope of Application
The following Terms and Conditions apply to all orders placed through our online shop by consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
For businesses, these Terms and Conditions also apply to future business relationships, without us having to refer to them again. If the business uses conflicting or supplementary General Terms and Conditions, their validity is hereby rejected. They will only become part of the contract if we have expressly agreed to them.

By placing products in the online shop, we make a binding offer to conclude a contract for these items.
You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided for this purpose in the order process.
The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract Language, Storage of Contract Text
The language available for the conclusion of the contract is German.
We save the contract text and send you the order data and our General Terms and Conditions by email. You can view the General Terms and Conditions on this page at any time. For security reasons, your past orders are not permanently accessible via the internet.

4. Delivery Conditions
We deliver free of charge within Germany for purchases over €59, unless otherwise stated in the online shop.
Outside of Germany, country-specific shipping costs may apply. The available delivery countries, shipping methods, shipping costs, and delivery times are displayed during the order process.
We deliver exclusively by shipping. Collection of goods in person is not possible.

5. Payment
Payment is generally made before the goods are shipped.
The available payment methods are displayed at checkout. In particular, we offer PayPal, Klarna, credit card payment via Mollie, and, if applicable, bank transfer/prepayment.
For payment by bank transfer/prepayment, the order will only be processed or shipped after receipt of payment.
Depending on the chosen payment method, payment processing may take place via external payment service providers. The conditions of the respective payment service provider also apply, provided they are effectively included in the order process.

6. Right of Withdrawal
Consumers have the statutory right of withdrawal. The details can be found in our cancellation policy.
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
Please note: The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Opened, unsealed, or already used products may therefore be excluded from withdrawal.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement, for example by email or post.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

7. Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back or hand over the goods without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us.

The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

8. Transport Damage
If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately.
Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

9. Warranty and Guarantees
The statutory liability for defects applies, unless otherwise stipulated below.
For consumers, the statutory warranty rights apply.
For businesses, the limitation period for claims for defects is one year from the transfer of risk. The statutory limitation periods for recourse claims remain unaffected.
For businesses, only our own statements and product descriptions included in the contract are considered an agreement on the quality of the goods. We assume no liability for public statements by the manufacturer or other advertising statements.
If the delivered item is defective, we shall first, at our discretion, provide a warranty to businesses by remedying the defect or by delivering a defect-free item.
The foregoing limitations and reductions of periods do not apply to claims based on damages caused by us, our legal representatives, or vicarious agents:
in case of injury to life, body or health
in case of intentional or grossly negligent breach of duty as well as malice
in case of breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely
within the scope of a guarantee promise, if agreed
as far as the scope of the Product Liability Act is opened.

10. Liability
We are liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.
In the event of slight negligence in the breach of essential contractual obligations, we are only liable for the typical, foreseeable damage. Essential contractual obligations are those obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose observance you may regularly rely.
Further liability is excluded, as far as legally permissible. Liability under the Product Liability Act remains unaffected.

11. Notes on CBD Products and Disclaimer
Our products are not intended to diagnose, treat, cure, or prevent any disease.
Our articles, product information, and other content do not replace professional advice from doctors, pharmacists, or other medical professionals and may not be used as a basis for independent diagnosis, treatment, or modification of a medical therapy.

We assume no liability for damages or consequences arising from improper use, further processing, unintended use, illegal consumption, or resale of our products, as far as legally permissible.

12. Dispute Resolution
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

13. Minors
We do not offer products for purchase by minors. Our products may only be purchased by adults. Persons under 18 years of age are not permitted to purchase our products.

14. Subscription Contracts
Subscription contracts end after the respective selected term. Your contract thus automatically ends with the last agreed delivery according to the selected minimum subscription term.
Early termination requires written form and compliance with a notice period of one month. However, termination is not possible before the second delivery has taken place.
The delivery of the goods and the debit of the subscription amount take place monthly.

15. Final Provisions
If you are a business, the law of the Republic of Cyprus applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies insofar as the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.
If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you, as far as legally permissible, is Larnaca, Cyprus.
